Dealing with a debt collection agency is something that no one wants to do. However, at some point in life, most people will have to deal with them because an unpaid account will eventually be turned over to a collection agent. Collection agencies are usually a nuisance, however, if you never deal with them, they will never go away. When you answer the phone, there are certain things that the collection agent can not do. Here are a few things to consider about your rights being violated by a collection agency and how to report it.

When a debt collector contacts you, they are allowed to talk to you about collecting the debt. They will usually let you know immediately that they are calling you for that reason. When they start to talk to you, there are certain things that they can not say. Here are a few violations of your rights when it comes to debt collectors talking to you.

  • Harassment- A debt collector can not harass you in any manner. If they call you repeatedly, threaten you with violence, or curse at you, you can file a complaint.
  • Calling during off-hours- If a debt collector calls you before 8:00 a.m. or after 9:00 p.m. they are in violation of your rights. 
  • Lying- If they misrepresent anything during the conversation, they are violating your rights. If they tell you they are someone besides a debt collector, then they are breaking the law. If they tell you that you owe another amount besides what you owe, they are also breaking the law.

If you have been the victim of any of these violations, you should not hesitate to report them to the proper authorities. When something like this happens to you, you need to contact the Federal Trade Commission. They are the governing body that protects consumers and debt collection agencies have to report to them. If you have had any problems with a debt collector, this is the first place that you should go under any circumstances.

If you want to file a complaint against a debt collection agency, you need to take the proper actions. You can contact your state's attorney general's office and let them know that you would like to file a complaint. You can access their website or call them on the phone to do it. You also need to access the FTC's website or call them directly. Contacting both agencies will make sure that the matter is handled the way that it should be.
